These Terms of Service ("Terms") govern your access to and use of the Arceus LLM service ("Service"), operated by Sait Burak Yücekaya ("we," "us," or "our"), a sole proprietorship registered in Turkey. The Service provides access to third-party AI language models through WhatsApp.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Description of Service

Arceus LLM is an AI-powered chatbot platform that enables users to interact with various large language models (LLMs) — including but not limited to GPT-4, Claude, Gemini, and others — through the WhatsApp messaging platform. The Service acts as an intermediary, forwarding your messages to selected AI models and delivering their responses back to you via WhatsApp.

2. Eligibility

• You must be at least 16 years of age to use the Service.
• You must have a valid WhatsApp account.
• You must comply with WhatsApp's Terms of Service at all times.
• By using the Service, you represent that you meet all eligibility requirements.

3. Account & Access

Your WhatsApp phone number serves as your account identifier. You are responsible for maintaining the confidentiality of your WhatsApp account. You agree to notify us immediately of any unauthorized use.

4. Acceptable Use

You agree not to use the Service to:

• Generate, solicit, or distribute illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable content.
• Violate any applicable laws or regulations.
• Infringe on the intellectual property rights of any third party.
• Attempt to reverse-engineer, hack, or disrupt the Service or its infrastructure.
• Send spam, bulk messages, or automated queries beyond normal usage.
• Impersonate any person or entity.
• Use the Service to generate content that violates the WhatsApp Business Policy or the WhatsApp Terms of Service.
• Use the Service for any purpose that could harm minors.

We reserve the right to suspend or terminate your access if you violate these terms.

5. AI-Generated Content

• Responses from the Service are generated by third-party AI models and may not always be accurate, complete, or up-to-date.
• AI responses do not constitute professional advice (medical, legal, financial, or otherwise). Always consult a qualified professional for important decisions.
• We do not guarantee the accuracy, reliability, or suitability of any AI-generated content.
• You acknowledge that AI models may occasionally produce incorrect, biased, or inappropriate outputs.

6. WhatsApp Platform Compliance

The Service operates through the WhatsApp Business API provided by Meta Platforms, Inc. By using the Service, you acknowledge that:

• WhatsApp's terms, privacy policy, and community guidelines apply to all messages sent through the platform.
• WhatsApp may access message metadata (such as timestamps and phone numbers) as described in their Privacy Policy.
• We comply with the WhatsApp Business Messaging Policy and WhatsApp Business Terms of Service.
• Arceus LLM is not affiliated with, endorsed by, or sponsored by Meta Platforms, Inc. or WhatsApp LLC.

7. Messaging Consent & Opt-Out

• By messaging us on WhatsApp, you consent to receive AI-generated responses to your queries.
• If you opt in via our website, you additionally consent to receive service updates and promotional messages from Arceus LLM.
• You may opt out of promotional messages at any time by sending "STOP" to our WhatsApp number or by contacting us at contact@arceus.it.com.
• Opting out of promotional messages does not affect transactional or service-related communications.

8. Fees & Payment

The Service may offer free and paid tiers. If you subscribe to a paid plan:

• Fees are as displayed at the time of purchase and are subject to change with notice.
• Payments are processed through secure third-party payment providers.
• Refund requests will be evaluated on a case-by-case basis.

9. Intellectual Property

• The Arceus LLM name, logo, website design, and branding are the property of Sait Burak Yücekaya.
• You retain ownership of the content you submit to the Service.
• AI-generated responses are provided for your personal or business use. You are responsible for ensuring your use complies with applicable laws.
• WhatsApp and the WhatsApp logo are trademarks of Meta Platforms, Inc.

10. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Service, you consent to the practices described in the Privacy Policy.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted, timely, secure, or error-free.
• The results obtained from the Service will be accurate or reliable.
• Any defects will be corrected.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ARCEUS LLM, ITS OWNER, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

Our total liability for any claims arising from or related to the Service shall not exceed the amount you have paid us in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless Arceus LLM and its owner from any claims, damages, losses, and expenses (including legal fees) arising out of your use of the Service or your violation of these Terms.

14. Termination

• You may stop using the Service at any time.
• We may suspend or terminate your access at our discretion, with or without notice, for any violation of these Terms.
• Upon termination, your right to use the Service ceases immediately. We may delete your data in accordance with our Privacy Policy.

15. Changes to These Terms

We may modify these Terms at any time. Material changes will be communicated via our website or through the Service. Continued use after changes constitutes acceptance of the updated Terms.

16. Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Turkey.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Arceus LLM regarding the Service.
